General Terms and Conditions

This website is operated by Frijs Goods BV (trading as Solewise). Throughout the site, the terms "we," "us," "our," and "company" refer to Frijs Goods BV. By visiting our site and/or purchasing something from us, you agree to our services and to be bound by the following terms and conditions.

ARTICLE 1 - DEFINITIONS

In these terms and conditions the following terms shall have the following meanings:

Reflection period: the period within which the consumer can make use of his right of withdrawal;

Consumer: the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the entrepreneur;

Durable medium: any instrument which enables the consumer or the entrepreneur to store information addressed personally to him in a way accessible for future consultation and unaltered reproduction of the stored information;

Right of withdrawal: the option for the consumer to cancel the distance contract within the cooling-off period;

Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers;

Distance contract: an agreement concluded between the consumer within the framework of a system organised by the entrepreneur for the distance sale of products and/or services, whereby up to and including the conclusion of the agreement exclusive use is made of one or more techniques for distance communication.

ARTICLE 3 - APPLICABILITY

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and orders concluded between the entrepreneur and the consumer. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If the distance contract is concluded electronically, the text of these general terms and conditions can be made available to the consumer electronically in such a way that the consumer can easily store it on a durable data carrier.

ARTICLE 4 - THE OFFER

The offer is non-binding. The entrepreneur reserves the right to modify and adapt the offer. The offer contains a complete and accurate description of the products offered. If the entrepreneur uses images, these are a true representation of the products offered. Obvious mistakes or errors in the offer are not binding on the entrepreneur. The entrepreneur cannot guarantee that the displayed colors exactly match the actual colors of the products.

ARTICLE 5 - THE AGREEMENT

The agreement is concluded when the consumer accepts the offer. If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of acceptance of the offer electronically. As long as the entrepreneur has not confirmed receipt of this acceptance, the consumer may terminate the agreement. The entrepreneur may investigate whether the consumer can meet their payment obligations. If, based on this investigation, the entrepreneur has good reason not to enter into the agreement, they are entitled to refuse an order or request with reasons.

ARTICLE 6 - RIGHT OF WITHDRAWAL

When purchasing products, the consumer has the right to cancel the agreement without giving reasons within 14 days. This cooling-off period begins on the day after the consumer receives the product. During this period, the consumer must handle the product and packaging with care. If the consumer wishes to exercise their right of withdrawal, they are required to notify the entrepreneur within 14 days of receiving the product via support@solewise.nl. After the consumer has indicated their intention to exercise their right of withdrawal, they must return the product within 14 days. The consumer must prove that the delivered goods were returned on time.

ARTICLE 7 - COSTS IN THE EVENT OF WITHDRAWAL

If the consumer exercises their right of withdrawal, the costs of returning the products are at the consumer's expense. If the consumer has already paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than 14 days after withdrawal.

ARTICLE 8 - EXCLUSION OF RIGHT OF WITHDRAWAL

Exclusion of the right of withdrawal is possible for products:

  • which have been created by the entrepreneur in accordance with the consumer's specifications;
  • that are clearly personal in nature;
  • which by their nature cannot be returned;
  • that can spoil or become outdated quickly;
  • for hygiene products where the consumer has broken the seal.

ARTICLE 9 - THE PRICE

We reserve the right to change the prices of the products offered during the validity period stated in the offer. All prices are subject to printing and typographical errors. We deliver exclusively to the Netherlands and Belgium .

ARTICLE 10 - CONFORMITY AND WARRANTY

The entrepreneur guarantees that the products comply with the agreement, the specifications stated in the offer, reasonable requirements of soundness, and existing legal provisions. A guarantee provided by the entrepreneur, manufacturer, or importer does not affect the consumer's statutory rights. Any defects or incorrectly delivered products must be reported to the entrepreneur in writing within 14 days of delivery via support@solewise.nl.

ARTICLE 11 - DELIVERY AND EXECUTION

The entrepreneur will exercise the utmost care when receiving and fulfilling orders. The delivery address will be the address the consumer has provided to the company. The company will fulfill accepted orders expeditiously, but no later than within 30 days, unless the consumer has agreed to a longer delivery period. If delivery is delayed, the consumer will be notified no later than 30 days after placing the order. In that case, the consumer has the right to terminate the agreement free of charge.

ARTICLE 12 - PAYMENT

Amounts owed by the consumer must be paid using the chosen payment method. The consumer is obligated to immediately report any inaccuracies in the payment information provided or stated to the entrepreneur.

ARTICLE 13 - COMPLAINTS PROCEDURE

Complaints about the performance of the agreement must be submitted fully and clearly described to the entrepreneur within 7 days via support@solewise.nl. Complaints submitted to the entrepreneur will be answered within 14 days. If the entrepreneur finds a complaint to be justified, the entrepreneur will, at its discretion, replace or repair the delivered products free of charge.

ARTICLE 14 - COMMERCIAL RETURN POLICY (30 DAYS)

In addition to your statutory right of withdrawal, we offer a 30-day returns policy. If you use this policy, you will receive a refund minus the cost of the return label we provide. Refunds will be processed within 7 business days of receipt and inspection of the returned item.

ARTICLE 15 - CANCELLATION

Want to cancel before shipment? Please contact us as soon as possible at support@solewise.nl. If your order has already shipped, you can exercise your right of withdrawal or the 30-day return policy.

ARTICLE 16 - WRONG/DEFECTIVE ITEMS AND EXCHANGES

Did you receive an incorrect or defective item, or would you like to exchange it? Please contact us within a reasonable time after discovering the issue at support@solewise.nl with photos and your order number. We will arrange a repair, replacement, exchange, or refund in accordance with applicable law.

ARTICLE 17 - DISPUTES

Agreements between the entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law.

ARTICLE 18 - PERSONAL INFORMATION

Your submission of personal information through the store is subject to our Privacy Policy.

ARTICLE 19 - ERRORS, INACCURACIES AND OMISSIONS

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice.

ARTICLE 20 - CHANGES TO THE TERMS OF SERVICE

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
